Vacations are meant to be fun for everyone. The MS Gulf Coast is known for its family-friendly destination and activities! Every year, we reach out to our loyal guests to encourage them to respect everyone staying at our properties. All of you have traveled and planned for a wonderful vacation and because of this, anything less than respectful behavior will not be tolerated.

Renters must be at least 25 years old. No condominium or beach house will be rented to persons under 25 years of age. The adult who made the reservation is required to check-in. Adult supervision of underage occupants is required at all times on the properties we manage, and failure to do so will result in the removal of the party and forfeiture of all payments.

Please note, only toilet paper can be flushed down the toilets. All wipes, feminine products etc will clog grinder pump and you will be responsible for repair/replacement of pump.

If you are booking one of our properties in Timber Ridge Subdivision:

This is a community with full time residents. No load noises will be tolerated. Must be 25 or older to book.

Timber Ridge Covenants do not allow any vehicle/trailer to be parked on the grass or on the road. All vehicles must be parked in the driveway. Trailers must be stored under the house. There is a $100 fine per violation per day for each violation.
Pursuant to Covenant 3 E.
Non-operational vehicles are prohibited. Recreational vehicles (including, but not limited to boats, boat trailers, travel trailers, camp trailers, motor homes, cargo trailers) or any similar vehicle shall not be kept on any Roadway, or stored on any Lot except behind the front sill of the residence or within a garage or an enclosed screened area. No repairing or overhauling of any vehicle is allowed on any part of a Lot, or any Roadway. All vehicles have to be parked on driveways.

Only 4 people per household are allowed in the community pool area at a time. Anyone under 16 must be accompanied by an adult 25 and over.

UNIT SPECIFIC TERMS

- Due to local laws or HOA requirements, guests must be at least 25 years of age to book. Guests under 25 must be accompanied by a parent or legal guardian for the duration of the reservation.

- No dog(s) are welcome in this home. No other animals are allowed.

- The property shall not be used by more than the number of adults and children listed in your reservation. - All guests shall abide by O'Dwyer Realty's good neighbor policy and shall not engage in illegal activity. Quiet hours are from 10 p.m. to 8 a.m. - If early check-in is available for your reservation, you will be notified by 9am on the morning of your arrival by email. Late check-out is offered whenever possible for a small fee. - No smoking of any kind is permitted anywhere on the premises. - No commercial photography or filming is permitted on the property. Tents or other structures may not be erected. - Renter is liable for any damage to the property and agrees to accept charges to the card on file should damage occur during occupancy. - Due to local laws, regulations, or Homeowner Association rules, guests may be required to agree to additional terms of service.

How to Report Damage

Please report accidental damage as soon as it occurs so we can assess and minimize the extent of the damages. To report accidental damage, please call Chelsea or Rebecca, depending on the unit you are occupying.

POLICIES AND ADDITIONAL TERMS

1. Minimum Age. The “Minimum Age” to rent the Property is the age specified in any Unit-Specific Terms. If no age is specified in the Unit-Specific Terms, the Minimum Age is 25 years of age (or the minimum age required by law in the jurisdiction where the Property is located, if different). You agree to provide us with proof of age upon request. A parent or legal guardian must accompany all guests who are under the Minimum Age for the entire duration of the rental.

2. Maximum Occupancy. The number of people present at the Property may not exceed the maximum posted occupancy.

3. Good Neighbor Policy. Because the Property is a privately owned home, all Occupants must comply with this good neighbor policy: - Please treat the Property with the same care you would use with your own residence and leave it in the same condition it was in when you arrived. - To prevent theft of or damage to furnishings or your personal property, you agree to close and lock doors and windows when you are not present at the Property and upon check-out. - You and other Occupants agree to conduct yourselves throughout your stay in a manner that is respectful of and not disruptive to neighbors, traffic flow, or the community and that will not prompt complaints to O'Dwyer Realty from police, neighbors, or neighborhood or homeowner associations. - Noise audible outside the Property is prohibited between 10 p.m. and 8 a.m. - You and other Occupants agree to abide by all applicable parking restrictions and limitations.

4. No Smoking. No smoking is permitted at the Property (including porches, decks or outdoor areas) at any time.

5. No Permanent Residence. You agree that your use of the Property is on a temporary and transient basis only; that you may not use the Property as a permanent residence; and that your permanent residence is and will remain elsewhere than at the Property.

6. Events; Commercial Photography; Structures; Charcoal Grills. Parties and other events are prohibited at the Property. Commercial photography and filming are also prohibited at the Property without our express written permission. (If approved, applicable occupancy limits and other rules under Airbnb's Party and Events Policy will apply, and additional conditions and fees may apply.) No tents or other structures may be erected on the property.

7. Criminal Activity Prohibited. Use of the Property for any criminal activity is prohibited and may result in fines, prosecution, and/or your immediate removal from the Property. This prohibition extends to use of the Property’s internet service, if any, for criminal activity, including but not limited to unlawful downloads of copyrighted material, including movies, music, software, or other material. We may cooperate with any investigation of alleged criminal activity that occurred at the Property during your stay.

8. Consequences of Breach; Charges for Damage. Any failure by you or any other Occupants to comply with any of the terms, conditions, or policies above is a breach of these O'Dwyer Realty Terms and may result in a forfeiture of your rights to rent the Property, up to and including immediate removal from the Property without refund and with or without the assistance of law enforcement. O'Dwyer Realty may terminate your occupancy of the Property for breach, and if you are notified of such termination you agree to leave the Property immediately. In addition, you are responsible for (1) any damage or loss that occurs at the Property during your stay; (2) a charge of up to $1,000 for violations of the pet policy, including for bringing more pets or different types of pets than specifically authorized; (3) an additional cleaning fee of up to $500 (or the actual cost of cleaning services, if greater) for violations of any of the guest policies above (other than the pet policy) or for excessive cleaning required by the acts or omissions of any Occupant during your stay; and (4) any fines issued by police, other government officials or agencies, utility providers, and/or homeowner associations for violation of any law, ordinance, or rule during your stay, and any damages (which may exceed the amount of fines) that result from the violation. If any unauthorized download of copyrighted material via the Property’s Internet service occurs during the period of your stay, you agree that we may obtain and share your contact information with the internet service provider or any other party we believe, for any reason, has enforcement rights.

9. Early Check-In/Late Check-Out. Early check-in or late check-out may be available; additional charges may apply. If you do not vacate by check-out time (or late check-out time as agreed by O'Dwyer Realty), you authorize us to charge a late departure fee of up to one night’s rental and we may remove all Occupants and their personal property from the Property.

10. Maintenance or Housekeeping Issues; Property Conditions. The Property is provided as is, and we are not responsible for the inoperability or unavailability of any amenities. You agree to contact O'Dwyer Realty, using the contact information provided in your confirmation email, as soon as you notice any maintenance or housekeeping problem, or any potentially hazardous condition, at the Property, or if any incident occurs at the Property that is related to such a problem or condition. You further agree to give O'Dwyer Realty a reasonable amount of time to respond to your report and to cooperate with O'Dwyer Realty’s efforts to address the concern or provide a remedy. We will take reasonable and appropriate steps to remedy any reported problem as soon as practicable. We may enter the Property at your invitation to remedy any problem you report, at reasonable times and with reasonable notice to inspect, maintain, or repair the Property, and to address any situation that we reasonably deem an emergency that threatens persons or property. You acknowledge that if the Property has access to amenities that are shared with other properties, such as a shared pool, hot tub, parking lot, or fitness center, that the availability and condition of those amenities is outside O'Dwyer Realty’s control.

11. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO CASE SHALL THE OWNER OF THE PROPERTY OR O'DWYER REALTY, NOR THEIR AFFILIATES, NOR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR OWNERS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, OR FOR ANY DAMAGES FOR PERSONAL OR BODILY INJURY, EMOTIONAL DISTRESS, OR DAMAGE TO PROPERTY, ARISING OUT OF OR IN CONNECTION WITH YOUR STAY AT THE PROPERTY. THIS LIMITATION APPLIES TO ALL CLAIMS FOR DAMAGES WHETHER BASED ON A THEORY OF WARRANTY, CONTRACT, TORT (INCLUDING ORDINARY NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF O'DWYER REALTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE AND EVEN IF THE LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

12. Indemnity. You agree to hold harmless and indemnify O'Dwyer Realty and Owner, and their respective affiliates, for and from all claims for property damage, personal injury, or monetary loss resulting from your actions or omissions, and the actions or omissions of other Occupants, during or relating to your stay.

13. On rare occasions, due to ownership changes, properties being removed from rental use, or a need for extensive repairs or maintenance, the Property may not be available for rental on the dates of your reservation and O'Dwyer Realty may have to cancel your booking.

14. Assignment. O'Dwyer Realty may assign these Terms or any of its rights, or delegate any of its duties under these Terms, at any time without your consent.

Cancellation Policy

You will receive a Full Refund on any cancellation prior to 30 days from arrival. Any bookings within the 30 day window will receive a 0% refund.

Inn by the Sea House Rules:

THE FOLLOWING ARE HOA GUIDELINES & FINES FOR VIOLATIONS OF THE ASSOCIATIONS' DECLARATIONS & BY - LAWS:

SECURITY CHECK-IN:

All guests/visitors must check in with the office upon arrival. If you arrive after hours, you must check in the following morning.

Carts are available on the garage floor level next to elevators for the use of owners and guests. (PLEASE RETURN CARTS TO GARAGE LEVEL NEXT TO ELEVATORS IMMEDIATELY AFTER USE – DO NOT LEAVE CARTS IN ELEVATORS OR IN FRONT OF UNITS).

POOL RULES AND FINES VIOLATIONS:
No LIFEGUARD on Duty: If you swim in the pool, you do so at your own risk. Children under 14 years must be accompanied by an adult. Pool hours are from 9AM to 10PM.

NO GLASS IN POOL ARES: ABSOLUTELY no glass items in pool area are permitted due to the possibility of breakage and or injury.
$50 for first notice by HOA Staff or Security; $75 for second notice by office or security and if notified a second time, a $75 fine attached to their stay or the owner’s unit, proceed with eviction from the property by the Sheriff’s office.

BROKEN GLASS IN POOL AREA: the renter/owner is financially responsible for the costs of draining, cleaning, and refilling of the pool. $5000+

NO FOOD IN POOL AREA: first notice by HOA Staff or Security (Warning to remove food from the pool); second notice by HOA Staff or Security $50

AROUND THE POOL DECK: No running, no diving or roughness is allowed in or around the swimming pool. Reserving chairs and/or tables not allowed. Food is permitted at the tables but not permitted in the pool.

NO LARGE FLOATATION DEVICES IN POOL:
NO NUDITY/LEWDNESS IN AND AROUND POOL DECK: First notice $100.00 fine.

WRIST BANDS POOLSIDE: All guests are required to wear a wrist band at all times.

IF NO WRIST BANDS BY GUESTS: First notice (WARNING) second notice $25.00; all subsequent notices $25.00
MUSIC OR LOUD NOISES: of any kind will NOT be permitted in pool area, courtyard, and or balconies after the hours of 10:00 PM as indicated by the Harrison County Board of Supervisors Noise Ordinance Article III 3.1.

BARBEQUE GRILLS: DO NOT ADD CHARCOAL in our PROPANE Barbeque Pits at any time!

BALCONIES: Towels, clothes or laundry of any kind may not be hung out or exposed on any part of the common areas and facilities and balcony railings.

WALKWAYS: Object blocking walkway causing a tripping hazard $50 fine.

EXERCISE ROOM: Children under 16 years must be accompanied by an adult.

OTHER VIOLATIONS:
PARKING VIOLATIONS: Vehicles must park in their designated reserved parking spots with their PARKING PASS clearly visible indicating their Reserved Parking Space Number, Condo Number, and Date of Arrival and Departure.

Violators will be fined as follows: Parked in NO PARKING or HANDICAP ZONE, Parked in RESERVED PARKING SPACE IN GARAGE, PARKING IN UNASSIGNED SPOTS or BLOCKING ACCESS to/from Building: $25 for First Notice, $50 for second Notice $200 for third and final notice. Any object stored in a unit’s assigned parking space shall not interfere with parking or driveway.

NO PET ALLOWED BROUGHT INTO THE IBTS PROPERTY: Renter is evicted from the property; Owner and/or rental agent shall be notified.

ILLEGAL DUMPING: Dumping furniture, or other large objects in front of garbage dumpster or down the trash shoots - the guilty party will be charged for the costs of removal and fined $100.

***THE INN BY THE SEA IS NOT RESPONSIBLE FOR ANY DAMAGE OR THEFT INCURRED WHILE YOUR VEHICLE IS PARKED ON OUR PROPERTY**

During your stay we appreciate your cooperation with respect to thermostats keeping them at a comfortable level and keeping doors closed. In addition, we request all adults be vigilant in their supervision of children for safety and proper care of our condominiums. We have furnished these units nicely in anticipation of your pleasure, comfort and convenience. Please be sure all contents of the condo are returned to the unit if taken outdoors. Please REFRAIN from taking glass outside the unit to the general areas & beach. The NO GLASS rule is strictly enforced, and will be held accountable if necessary. This is a safety issue. Maximum capacity in a 2 bedroom unit is 6 people. Maximum capacity in a 3 bedroom unit is 8 people.
The HOA has imposed fines to those disregarding general rules.
